Legal Question in Workers Comp in Texas
My husband was injured on his job (cut tendon in thumb.) He asked if he could personal days for the surgery and dr. appts. His boss said no that worker's comp would be reimbursing him. However, worker's comp said he would receive no money unless he took a total of 7 days off because of the injury. We have lost quite a bit of money because of this and he is the only one currently working. Should he be getting money from somewhere? It seems he is being punished for being a good employee and returned to work the day after surgery. (He still has only about 20% use of his thumb as evaluated by the specialist worker's comp sent us to.)

Work comp insurance does not pay for first 7 days off unless the worker misses 30 days or more..his employer should have let him use personal days etc but it depends on the company policy..his rights to pay for days off..vacation etc...but perhaps he can talk to his boss or others and show them the law which you can find online...
