Legal Question in Workers Comp in Texas
impairment rating
My husband injured his shoulder back in May of this year. He was on modified duty for a short time and then was released after some pt. The doctor told him he would need surgery and referred him to a specialist. Being that his shoulder pain was under control and having heard horror stories about shoulder surgery he decided to wait and not see the specialist. He has since changed jobs and sometimes his shoulder flares up. He recently missed a week of work because of it. He received a letter recently from the insurance company saying his impairment rating was 0. Since he has lasting effects from the injury should he dispute this rating and if so how does he go about it ? He has tried calling the adjuster handling the case but she has not returned his calls.
