Legal Question in Workers Comp in Texas
Jinxed from the beggining
What do I do when my imployer did not want my accident reported to risk management. I had to report the acccident to the proper authorties after waiting for 7 days for my employer to report it. When I did report it to risk management. I was told that I had been fired just minutes before I called them that morning.
I have also been misdiagnosed, aqussed of altering medical documents, and anything else you can think of.
My workmans' comp. insurance company has been total ass-holes.
I have had two impairment ratings. One by my doctor 18% and another one by a designated doctor by twcc 25%. My insurance company will not approve either one of them.
I have a contested case hearing coming up in May, but untill then I am not receiving any medical treatments, no medications for my pain and depression. no nothing untill then.
Do have have a complaint against my ex-employer and my insurance company? What benifits am I intiled to while this is in limbo?

Re: Jinxed from the beggining
Texas law protects an employee from being fired for making a worker's compesnation claim. Also, you should have a representative at your CCH to ensure that all issues relating to the designated doctor's opinions are properly addressed. Be sure to comply with all appeal deadlines should you lose your CCH.
