Legal Question in Workers Comp in Texas

Settlement or Not?

My husband was hurt on his job when he fell off his pump truck about 12-14 feet. He injured his left knee, which in his younger days (high school, and he's now 40)he had to have 2 surgeries, 1 in 1976, and another in 1989. He tore his ACL in the knee and has to have reconstructive surgery. We receive 533.00 a week at the present, which is a big cut from his pay of anywhere of 800.00 to 1200.00 a week when he was able to work. Is he eligible for a lump sum settlement at any time during or after this surgery? If he is not able to perform his job like before the accident, can he get not only a settlement, but disability? What should we do? And how do we go about it?

You should seek the advice of a worker's comp lawyer in your local area. You may be entitled to a lump sum settlement of your impairment income benefits, but when you take the lump sum you will cutoff your rights to future claims if something goes wrong.
