Legal Question in Workers Comp in Texas

work injury no workers comp

I was injured at work and was unable to return to regular duties, the company dr said I reached mmi,and I was given 30 days to xfer out to a different position since I was unable to continue my reg job,of course I was not x'd out and was terminated. The dr said there was nothing else that could be done and that my pain was related to a previous injury. The company did not have workers comp, but the private ins did pay for medical visits, meds, and a percentage of the hrs I missed. The company also used my PTO for my wages. I had aprior surgery on my back a few years ago that was not work related.I went back to the previous surgeon after I was fired and was told I need to have surgery. Can the employer be sued for the termination or for the injury or for the dr saying I reached mmi when I hadn't? The back surgery was successful and had it not been for this work injury I probably wouldn't need surgery. I was working for this employer for 3 months when I got hurt and had been able to do hard manual labor before I got injured. I was injured by getting hit in the back with a basket that weighed a few hundred lbs. An employee moved the basket and it hit me in the back. I have not been the same since and have been having a lot of pain.
