Legal Question in Workers Comp in Texas

Workers Comp Second Opinion

I have been to a doctor for corpal tunnel, during which I was told my neck/cervical problems were related. I was sent to physical therapy for neck/cervical problems with workers comp approval. Now, after a month of being off of work as per doctors orders, to wear braces on both hands and attend physical therepy three times a week on my neck workers compensation has informed me to see a Doctor that they have chosen for a second opinion because the initial complaint that I made was for Corpal Tunnel. Can Workers Comp send me to a doctor of their chose for a second opinion. I have been seeing a neurologist with there approval and now they are sending me to a orthopedic surgeon of their choosing for a second opinion about the cervical problems.Workers Comp has not approved any more physical therapy ordered by my Doctor at this time.

Thanks for any help you can give.

Re: Workers Comp Second Opinion

Your question depends upon who you mean when you say "Workman's Comp" has set you for a second opinion. The insurance company may request second opinions and the Texas Workers' Compensation Commission may assign certain doctor's as a result of the insurance company's request. This is different than a "designated doctor." You should read the Texas Workers' Compensation Comission website for mor information, or feel free to give me a call at (877) 647-9600.
