Legal Question in Intellectual Property in Turkey

My web designs have been ripped off

I have discovered that a company from Turkey has ripped off two versions of my portfolio.I have tried to contact them, but failed to do so. Is there anything that I can do to force them take down the websites? Please note that I currently live in Romania.

Dear Sir

Of course you can take action against them according to the Turkish Code of ntellectual Properties. But it depends if you have legal protection over these designs or not (according to the romanian and/or European laws).

I was in Poiana Brasov for the last week by the way, great country!

Dear Sir/Madam,

It is possible to take legal actions against any infrigement of intellectual property rights here, in Turkey. But, actually, it is hard to lead you properly just depending on the information you mentioned in your email. In other words, more specific information needed so as to be able to give any reliable legal opinion.

If you need further inquiries please do not hesitate to contact me by the email address [email protected].

Sincerely,

Arzu YILMAZ McCONNEL, Attorney at Law

Re: My web designs have been ripped off

Dear Sir,

Turkey is a member of the Berne Convention. According to Berne Convention, authors shall enjoy, in respect of works for which they are protected under this Convention, in countries of the Union other than the country of origin, the rights which their respective laws do now or may hereafter grant to their nationals, as well as the rights specially granted by this Convention .

So, in order to claim rights and damages, the Author of a website (reproduced without authorization in Turkey) should follow the rules instituted by the intellectual property law of Turkey and contact a local lawyer.

Best regards,

Mihaela Giuraniuc
