Legal Question in Civil Litigation in United Arab Emirates

Dear Sir,

My Name is Shan, i am 27 years old, living in dubai since 7 years. I am an indian.

I would like to share my personnel problem with you and i would be greatful to you for your advise. i am mentioning the problems below:

I am in with a a girl, she is 18 years old. but unfortunately parents they dont like our relation ship. her father is very rude and strict. 4 times they caught us and they gave us warning very badly. whenver he cauught me i told him that i have no other relation ship with her rather than a frindship .the girls father is a rich guy and he has good hold even in the police departments. after 3 times caught, again my girl started calling m and we kept continuing our relation ship. again father caught while talkin to me on phone. so father called me again and told me that he can cancell and send me to india with life time ban. then he cut the line and after somtimes one guy called m saying dat he is from dubai police, he gave warning very badly to stop the relation ship but we could never stop.he stopped her study and she is any more going to school. 2 months back my girl and family gone india for vacation, even from india she kept talking to me.

Unfortunatley father fixed her marriage with one guy belong to her mother family, she asked her father that if she dont like to proceed with this marriage, but father told him that you must accept it, do what i say. so she had forced to agree that and parents agreed to have the marriage after 2 years. it was verball agreement, nothis was documented.

My girl and family came back from india, but they guy who is going to marry my girl is in india now, he will come to dubai after few months. parents gave her mobile as the guy said he wants to communicate with her. when she reached in dubai, she started calling me, we talk every day atleast 2 hours on phone. the guys is calling her somtimes just for family talk.

she can never leave me and marri with other guy, she is ready to come with me, if i call her she will come out any time.

My questions

1)- What if father come to know that we are in love and still taking on phone?

2)- what would be the reaction of father to both of us?

3)- If she she come with me now, how can we get married?

Hope you will give us legal advises, to avoid a bad end.

Dear Mr.Shan,

Hope the girl has attained the age of 18 years. You have not mentioned as to which religion both of you belong to. You may also mention as to which place in India both of you belong to. Only based on these can you be advised suitably.

As regards your queries, as to what would her Father do if he comes to know of both of you talking over the phone, all that can be said is that you would be very well knowing his attitude and behavior and so can make a guess as to what would be his likely reaction. As regards any legal action, as long as you are careful in not doing any illegal action for the present, he cannot do anything against you.

Regarding getting married over here, it would be a difficult proposition without her parents consent. You would have to get married under the Foreign Marriage Act. As per the same, a 30 days Notice is mandatory, alongwith Paper publication and the worst part is a copy of the Notice of Marriage would be sent to the address of both of your parents. This sort of Marriage would have to be conducted before the Indian Embassy official alongwith 3 witnesses.
