Legal Question in Real Estate Law in United Arab Emirates

We made an agreement with a Real estate in Ajman for buying an apartment. We paid about 5 installments and then stopped the installments due to recession and we lost our jobs. Now we want to get our money back which we paid to the real estate and cancel the agreement with them. I called real estate office but they said they can not give any money back to us.

My question is that can we sue the real estate in the court and would we be able to get our money back?

Please answer urgently.

This question is too short to answer. From your question, we are given to understand that you have defaulted the payment and you are demanding total refund of the money as well as termination of the contract. We would advise you to approach the developer and try to explain your situation and request them to settle the matter amicably, provided you are able to convince your situation, and it may work out. Please also be noted that the developer is under no obligation to agree any settlement.

Without perusing the documents signed between both the parties, we cannot provide you the answer for your question since, the refund and termination are depends upon the terms of the contract entered between you and the regulations of Ajamn Real Estate Regulatory Agency (ARRA).
