Legal Question in Administrative Law in United Kingdom

I have applied to go on a franchise they asked for initial downpayment of � 2,500 but when I went to my solicitor at the time he discouraged me to enter into this franchise. I have not signed any agreement with them. Will I be able to get my money back? I desperately need the money now.

It would seem that the advice given by the solicitor was absolutely correct.

Your entitlement to a return of the money will depend upon the terms on which it was paid. This was in effect a separate contract and did not need to be in writing. It may well be that the payment was for an option to acquire the franchise which you later decided not to take up. If so the money has gone.

I suggest that you have a further word with the solicitor who will advise you as certainly he should have considered at the time whether not proceeding would result in the loss of your down payment.

It depends on the circumstances surrounding the transaction. Was the deposit understood to be non-refundable? Try to approach them and see what they're willing to do. The business reality is they have your money and it may be difficult to get it back. If they are not amendable, you may have to contact your solicitor or another franchise attorney to write a letter on your behalf. Good luck!
