Laurel called by telephone and offered to sell a radio to Hardy for $150. Hardy accepted the offer by post,
together with a cheque for $50 and offered to pay the rest in 2 installments of $50. One day after receiving
this letter from Hardy, Laurel wrote to Hardy saying that he had decided not to sell the radio to him and
returned Hardy�s cheque of $50.
Advise Hardy if he could enforce the agreement.

In this case when hardy in response to the offer to sell the radio at 150 responded with a term of payment in instalment, so that way it will only amounts to a COUNTER OFFER , instead of an acceptance. so there is no agreement no contract.
