entrapment of business lease?
We have been trying to sell our shop lease since last september 2006and had a buyer keen to exchange but our landlord did not allow it at the last minute as he felt that it was a conflict in one of the other shops in which he owned- this is after nearly 12 weeks of him first deciding that it was okay for the prospective tenant, then changed his mind. Since this we have had to cease trading as our business failed in december 2006 although he agreed it would be okay that the rent that we owe which is now �3000 going soon into the second quarter of a further �2500 to the end of september. We have since had more interest in the shop to be used as a sushi bar of food to take away but the landlord has again not allowed this because one of his other tenants has got a greasy spoon cafe around the corner- my estate agent feels that this is extremley unreasonable behaviour as this is again no direct conflict. I am extremely concerned as the rent i owe is adding up and i feel that this could be entrapment. The biggest problem is that we cannot afford legal action as we have lost so much money and have no credit rating and are currebtly on a low income as well as being on a dmp with the cccs. I have 5 yrs left of the lease, and am distressed.
