Legal Question in Business Law in United Kingdom

European Agency Contract Law

I have a contract to run a retail outlet for a multinational since 1988 on a commission basis. My contract states that with due notice of termination I will be paid one twelveth of my annual commission up to a max of 12 years service. In otherwords,at this stage I will receive a years commission upon termnation.

I have now been told that european law superseads national law and I am entitled to a percentage of the retail turnover or whichever is the greater.Any advise, test cases or websites on this subject would be greatfully received. Many Thanks.

Re: European Agency Contract Law

If you are being told that by the multi-national, and you think they understood that from the beginning, you have a case for fraud, which could include punitive damages as well. I believe that for your case, the U.S. has the preferred jurisdiction, but that will depend on what, if anything, your contract provides on the subject.
