Legal Question in Business Law in United Kingdom

hateful personal attacks on an internet forum

I am a moderator of a games forum who has had to at times remove people for out spoken remarks and continued bad behavour. Over 12 months ago a seperate forum was created on a hosting/isp which I cannot track down, it has been used by mainly 5 people who where removed from this games forum to personaly attack me and use all sorts of insults.

After 12 months it still continues and I'm at a loss on how to get this stopped and as a last resaut am seeking legal advice, and would like to know where I stand, as this whole situation is getting me down.

Re: hateful personal attacks on an internet forum

IF the remaks about you are substantially untrue and are by their nature defamatory ie any disparaging statement then you have a claim for Libel aginst the makers of the statement. The ISP will probably not be liable but in some circumstances can be. Defamatory statements are usually in breach of an ISP terms of use and they might be persuaded to remove the Access if they consider that there is abuse.

If the ISP is not apparent then you may need to trace the names through ICANN etc
