I purchase a mare that was advertised in foal to a particular stallion.The mare was suppose to be 6 months out of an 11 month gestation period in foal when i agreed and paid for.
Subsquently she never produced a foal, do i have a right to a portion of my money back?
Is the seller liable to prove at the point of sale that the mare was in foal on that day?

The agreement which you had with the seller was for the purchase of a mare which was six months in foal. A foal was not produced and this is giving rise to the suggestion that what you were sold was not a mare in foal. This will be for you to prove and in all probability expert veterinary opinion will be required. If this can be forthcoming you will have a certain case either for the return of the mare and refund of your money or for damages in the amount of the difference between the value of your mare in and out of foal.
