Legal Question in Business Law in United Kingdom
Soliciting of Business
I resigned from a company I used to be a shareholder last year and set up my own company doing the same business as my previous office. When I was leaving, we came to an agreement that we will not solicit each others business.
Last week a client of my previous office came to me wanting to transfer his business to me because my previous office is reducing the commission they have been paying him.
Can I accept this client and work for him?
Will accepting this business amount to soliciting my previous offices business?

Re: Soliciting of Business
An agreement such as you entered into when you left your employment will be enforceable only so far as it is reasonable. I would need to read the terms of the agreement and have some further information from you before being able to advise whether it is reasonable and whether you would be in breachby taking this work. If you would like me to have a look at it please get in touch.
