address being used

When arrested someone gave my address as theirs which resulted in a search. How can i stop them using my address?

Hi. Thanks for your question to law guru which has been passed to me to answer. As I understand it somebody falsely gave your address to the police which resulted in you suffering the inconvenience and doubtless the embarresment of having your home searched. The question is what you can do to stop this happening again.

I am afraid probably very little. It is beyond doubt that you would have a civil claim against the person who falsely gave your address. Also if you were able to show that it was likely to happen again, you would be able to obtain an injunction forbidding this person to give your address. The problem however here is whether the expense of taking these actions is worthwhile. You must ask yourself whether it is likely that any damages ordered to be paid by the court would in effect be paid. For an injunction to be granted there must be a likelihood that the respondent to the action would be likely to repeat the matter complained of unless restrained from doing so by the court. I am not sure whether that is the case here.
