Legal Question in Consumer Law in United Kingdom
Where do you stand when given something
Five days ago we were given a pedigree dog for free asking that it just be given a good, loving home. The original owner now wants it back and is threatening us with Solicitors if we do not. Please could you advise where we stand with this. Should I offer to pay for the dog as we definately do not want to give it back. Before we agreed to take it she had an appointment to take it to the RSPCA and had declined an offer of 500 because she wanted my mum to have it as she is an old lady who is very lonely, hence I do not want to take this dog back from my mum now.

Re: Where do you stand when given something
When somebody makes a gift of something to another, ownership of that item passes to the other person in exactly the same way as if they had purchased it.
Here the dog was given to you and is therefore your property. It is not open to the previous owner to claim it back and there is no conceivable claim which solicitors if instructed could bring on these facts. As the dog is yours there is absolutely no need for you to offer payment for it.
