Criminal law inchoate offences

Sam was jealous of his best friend john and always used to think of ways by which he could defame him or hurt. One day he fabricated a story and told john that his wife ana was having an affair with one of his associates named tom.Sam siad to john if i hear something like this about my wife i will make sure i will kill her with my own hands.John beleived everythimg sam said they were best freinds the same day john went to see another friend kelly who dealt in arms and told him, the whole thing kelly agreed to provide him with a gun and said i will do the job with you as such woman deserve it late night both kelly and john went to johns house and they both fired shotd at anna anna died would your advice differ if anna was not at home advice the parties to criminal liability

Sam wil b charged instigating john to commit a crime,, john and kelly wil charged possesing illicit arms and intention to kil and making plan to kil some1, as wel as abetment u/s 109 ppc
