Legal Question in Family Law in United Kingdom

appeal

can my partner appeal against a decision made at a final hearing, now that his finacial situation and circumstances have changed. The order that he pays his ex wife 400 per month, is cripling us now that we are a family with 2 children in full time education. my partners youngest child is almost 18 and at work. He also had to give his ex 65% of his pension. We are getting into debt.

Re: appeal

It is most unlikely that an appeal from a final order in matrimonial proceedings will be possible. However if your financial circumstances have changed since the order was made, it will be possible to apply for a variation of the maintenance order. The procedure is set out on our website or you may wish for further guidance under our free advice service.
