husband leaves wife now divorce pending and have daughter nearly 12yrs resides with mother.Husband now resides with another male who are a gay couple planning to marry next year. Husband is having great difficulty with access to his daughter, what access rights does he have?Husband lives in Scotland. Wife and daughter in England

This daughter has an absolute right to contact with her father which is not affected by his present relationship or the breakdown of his relationship with her mother. The father should not hesitate to make an application for a contact order to the court for the area where his daughter resides
