Child custody application

My male friend is being denied access to his 2 school age children. Both children wish to see him and are distressed. No official custody arrangements exist - at the divorce several years ago, both parties mutually agreed that children would stay with their mother, with father having them 2 days per week. He pays maintenance every month, also agreed between parties at divorce. He has little spare money to take the case to court, but would like full custody of children now as he believes they are neglected. Both children have indicated they would be happy to live with their father, who is now remarried. His new wife is happy for this to happen. His ex wife became very bitter on learning of his remarriage, and is acting out of spite by denying him access. He talks to the children on the phone, and they are unhappy about not seeing him. Children are boy of 14 and girl of 6. Would their wishes be taken into account by court of law? Father is in full time employment, new wife is housewife and prepared to look after them. He needs legal advice, he wants to go through correct channels. Both he and I are very worried about this situation, and any advice you can give would be greatly appreciated. Thank you.

I am afraid that there can only be one solution to this problem and that is an application to your local County Court for a contact order. It may well be that once proceedings have been issued the mother having taken advice will accept that what is in issue hear is the well-being of the children and that this calls for them to have full and proper contact with their father.
