I am divorced and wish to live in the US, I have dual citizenship, my 12 year old daughter wishes to immigrate with me, her father does not see her or send her xmas or birthday cards,or pay any maintenance for her, he was verbally aggressive to myself and my daughters, and often drunk, when we were married and I had to take out an injunction against him at one point. I am not sure of his whereabouts, but if I could locate him I am sure he would refuse to sign a notorised permission for my daughter to immigrate, could you tell me what other options are available to me, thanks.

Unless you can obtain the written consent of your daughter�s father to remove her permanently from the UK it will be necessary to obtain the Court�s leave. This is unlikely to be refused in the circumstances.
