Legal Question in Family Law in United Kingdom

Can my child be moved away from me.

I have been separated from my sons mother now for two + years. I have had custody of my son every weekend + holidays since the split. I live in Kent England and she tells me now she is going to move 500+ miles away from me to Scotland to start a new life. This will drastically affect the relationship between me and my son. My question is can she do this because the effect on myself and my son to loose contact will be terrible. The move is not related to work etc. I was never married to her.

Re: Can my child be moved away from me.

This is always a very unfortunate situation. Unfortunately there is absolutely nothing you can do (apart from persuasion) to stop your son's mother from moving to Scotland or anywhere else in the world she may choose.

On her move the question will then arise as to who should care for your son and what is in his best interest. If the answer to this question is that it is best for your son to live with his mother wherever she may now be living, there is little alternative in practice to the inconvenience and affect this will have upon your Contact with your son. Unfortunately the only alternative now open to you would be to apply to the court for a residence order requiring your son to live with you. Obviously I cannot comment on whether this would be successful without further information.

Please do not hesitate to contact us if we can help further.
