child-change of surname

a child aged 5yrs who never sees his father but is being supported financially by him - the mother wishes to change the child's surname to her own - how should she do this legally ?

The answer to your question will depend upon whether or not you were married to the father at the time of your child's birth. If you were, or if the father was later granted parental responsibility, then either his consent or an order of the court must be obtained before you may change the child's surname. If you were not married than no consent is required and you may simply proceed to change the name to your own with the option of executing and registering a change of name deed if you consider this necessary. There is no legal requirement however to do so. Please let me know if further information or assistance is required.
