Why is a clean break order needed after divorce? Can the ex wife/husband make a claim against their former spouses pension or estate if the divorce has been made final?

A divorce only brings to an end the marriage. The financial ties and obligations continue until dismissed by order of the court. an example is the inheritance act whereby a former spouse may make claims on the estate of a deceased husband or wife. There have been cases where as much as 25 years after a divorce when one party has come into money successful claims have been made. It is therefore essential that an order be made as to finances at the time the marriages dissolved.
