Can I have custody of my kids age 8 and 10 if the ex wife is drunk when she picks them up?

If you are able to show that your kids welfare requires them to live with you a residence order would be made by the court. Your ex-wifes conduct will be very relevant in this but there are also other factors which would influence the decision.
