Legal Question in Family Law in United Kingdom
My daughter has been married for nearly 10 years, has two children and has been extremely unhappy for almost 3 years now. Her name is not on the mortgage where all the family live. Her husband is verbally abusive and has wound her down and is now saying that if she leaves him, she will not have the children which I know is not true. If we, as parents, rent a house for her and the children for 6 months to get her out of the house, which is all we can afford, will she be able to get either a council house or apply to the housing benefit ie; Southdown Housing after that six months has expired.

although I have no knowledge of the ability of this Housing Authority to provide accommodation this will do not seem a good idea. It is largely irrelevant that your daughter's matrimonial home is in the name of her husband. This is a fairly long marriage and there are children who need to be accommodated. These would be relevant factors on divorce and so far as possible the financial settlement ordered would be directed to ensure that she and the children have somewhere to live. This could well be in the home with orders that could either be transferred to her all sold to provide funds for other accommodation.
The situation is such that full legal advice should be taken before she and the children move out of the home. let me know if I can help further.
