Deadbeat dad refuses to be served
My daughter's deadbeat dad left us and returned to the United Kingdom. My attorney served him with the custody/support papers, but the judge didn't accept the proof because it wasn't in accordance with international law (Hague convention). Anyway, 6 months later, my attorney still hasn't been able to serve him, and now wants me to sign paperwork releasing him from the case. I've spent almost $10,000 on this case and haven't gotten any results yet. I can't afford another attorney, and I haven't been getting any support from her dad.
When the process server goes to the deadbeat dad's house, his family says they don't know him...He's avoiding service by denying who he is...even though I've given them pictures! Also, isn't my attorney liable for the damages for serving him improperly the first time? Can he simply wash his hands of this case without my permission? He never returns my letters or phone calls anymore. What can we do? He's a former district attorney in California, and how in private practice.

Ask another attorney to look into a possible malpractice case for you. It sounds like your attorney was negligent and that you may be entitled to your money back. Also, the local district attorney will help you collect for free!
