name not on the deeds

I have been married for 23 years, but we have lived together before that for about 3 years. The mortgage is in my husbands name, but the endowment is in both our names. If we were to split up, would the house belong to my husband?

Almost certainly not.On divorce a court has an almost absolute discretion to vary property interests and after a long marriage where both have contributed it is almost irrelevant in whose name property is vested. You can therefore be quite confident of receiving at least 50% of the matrimonial home.

If you're marriage is in difficulty and with the property being in your husband's name, you should enter a matrimonial charge against the property fourth win of. Details of how this can be done are available from our website.
