Legal Question in Family Law in United Kingdom

divorce

My daughter, an Indian citizen, was married ,also to an Indian citizen in India. He has been harassing and abusing her constantly for the last 2 years- married for 3 years- aided ably by his mother. They are both living and working in the UK. Now that divorce is the only way out, should they come back to India to file for divorce- which they can if both agree- or is it possible to get divorced in UK ? How long will it take to get a divorce in UK if both agree ? How much will it cost?

Thank You.

Re: divorce

i am not aware of UK laws but they are not much different as far as basic law is concerned.

u can come to india if u want otherwise i feel that they can take divorce there too. the procedure is fast there but very costly in comparison to indian courts.

u can contact personally for further details.

Re: divorce

your daughter is entitled to several reliefs under Indian laws.

However, if she wants only divorce, she need not to return to India.

the courts in UK can grant them divorce by mutual consent. both of them will need to visit the court of their area and submit an application. the court will then sent a written notice to both seeking confirmation of their consent for divorce; as also giving them a chance to reconsider their decision. you may submit consent and divorce shall be granted.

it is not a costly affair; you will not need to engage any lawyer for this purpose;

you are welcome to seek further advice, if required.

NO CHARGES.
