My husband wants to leave & live his own life. My boys are 19 and only just 16. Eldest works but is still dependent on us and youngest is doing GCSE and will go to 6th form for 2 years. I work full time but would not be able to afford house on my own easily. Can he make me sell the house or is he liable to support the family in any way at all. I want to keep my home for me and the kids it is afterall his wish to leave and end our marriage not mine. I have left my home country 10 years ago to come to England and have worked hard to settle down also left a good job to help him set up his business worked for no salary for 3 years and since he has sold the business and I am back at work I have to pay for half of all the bills although he earns more than twice what I do. Is it unfair to pay less than half as I will always be out of pocket due to the fact that I don't earn as much as he does. What are my rights I don't want to be unfair but at the same time feel that the split of costs is not correct? I want to stay where I am it would be very hard to get mortgage on my current salary this will put alot of pressure on my finances and the kids do not want to move what are my options please could you advise.

You should have no doubt that the law does not permit a party to a marriage to simply walk away from family responsibilities because of a choice to lead an independent life. The consequence of your marriage is that your husband has responsibilities to you and the consequence of having children is that he has responsibilities to them.

That said however I am unable to advise on the extent of these responsibilities without much further information. If you remain married these obligations are unaltered by the fact that you are living separately. If you decide to divorce property rights will be dealt with in accordance with the procedure explained in the Legal Zone Ancillary Proceedings Kit
