Legal Question in Family Law in United Kingdom

Emigrating to Australia

I wonder if you could help me. My soon to be ex-wife has just announced that she is moving to Australia with our two children aged 3 & 4. Is she able to do this without my consent and do I have any say in the matter?

Many thanks.

Re: Emigrating to Australia

You have parental responsibility for your children and as such their mother may not remove them permanently from the UK to live in Australia without either your written consent or the permission of the court.

You most positively have a say in your children's upbringing which it is not affected by the divorce. If there is a realistic prospect of your wife absconding with the children you should immediately apply to the court for a prohibited steps order.
