father deceased

when my father died he was no longer living with my mum, moved in with a lodger, who on his death interfeered with his belongings and got her and my dads work place invoved by getting them to hold me and my family at their work place for whatever reason,my dads mistress recieved my dads benefit from work which was a substantial amount and has refused to help pay for funeral and towards his debts, my question is, are we right to expect her to pay these costs? as there was no will or monies left to us.

When your father died, his whole estate passed by virtue of the Intestacy Act to his next of kin. This could be your mother if he was still married to her, and if not is likely to be you and any other children he had. A girlfriend or cohabitee will not usually inherit anything. It is therefore highly likely that you or your mother are entitled to this benefit from work.

You will need to apply for what is known as letters of administration to the estate. If you require further help in doing this or concerning your entitlement, please let us know
