Legal Position
I have cohabited with my partner for nearly four years. We have a property purchased between us and a legally signed agreement based on the proceeds from our respective house sales and this to purchase current homestead, the property is based on a 36/64 ratio. She has two children from her first marriage for which she receives maintenance... I have not worked for almost two years and have therefore been unable to contribute, although prior to this all my net salary �50,000 went to support her family and obviously myself. However, I have run her business unpaid for the last two years and in that time increased her income to 62%... She is using the childrens emotional issues to enforce me to leave for a loose period of time suggested six - 12 months, what should I do and where do I stand legally, the mortgage is in joint names.

Your entitlements to shares in the jointly owned property will be in accordance with the agreement signed when you purchased. If you require the property to be sold in order that you might take your share then an order for sale can be obtained from the court. If this is not what is required by you, it will be necessary to come to some agreement with your partner. This is possibly a case where family mediation could help.
