marital home

Husband left 18 months ago. Home jointly owned. Mortgaged. Can I add a conservatory without his permission. Finance not secured on property

Your husband has now vacated the home and you are in possession. Although he certainly has rights as a joint owner, what you are proposing can only increase the value of the house, and I cannot see that he would have any right to prevent you carrying out this work.

Although I am sure that you can go ahead and build your conservatory, the situation as it stands is far from satisfactory.Your husband will have a claim upon the increase in value, be it from improvement or inflation, and even if you do not intend to have the marriage dissolved at the present time, you really should consider entering into a separation agreement to deal with the various matters in which you remain linked.
