Marriage

Hi,

I have heard that prenups are not used in the UK but is there any way when I get married next year that I can have some legal documentation/method to keep my 2 flats as my own and not have my husband become half owner? He is also more than happy to have them stay in my name as before the marriage. I would be happy to pay to have this documentation drawn up.

Prenuptial agreements are becoming more and more used in the UK. The difficulty is that on divorce the court has an absolute discretion which cannot be fettered as to the division of the matrimonial assets. For that reason a prenuptial agreement is not binding on a court but they are becoming increasingly persuasive and if freely entered into would certainly be given every consideration by a court.

My advice is certainly to enter into a the prenuptial agreementbefore you get married. Suitable agreements can be downloaded from our website.
