Parental rights

3 year old child, mother and father seperated when mother pregnant but still married when child born. Father never seen child, never paid maintainance, has nothing to do when child. Mother and father now divorced. want to know the rights of the father. does mother have to have fathers permission to change childs surname.

Re: Parental rights

Although this father may have played no part in the upbringing of the child, he will still have parental responsibility as he was married to the mother at the date of birth. As such his written consent or leave of the court will be required to change the child's surname.
