Property rights in a bigamy case

I was granted an annulment (absolute) in 2001 based on my partner's bigamy. However, before that, when I believed that she was my lawfully wedded wife, I bought a house in our joint names. She was a housewife at the time and her name is on the property only because it was required by the bank. When we separated in 1995, she continued to live in the house and took over paying the mortgage which she currently continues to pay. How can I get my home back?

Your marriage to this woman was declared void and as if it had never happened.However during the time in which you believed that she was your lawful wife, you jointly purchased a property for her occupation.You was persuaded to do this by a belief and representations made by her which were false.

It will now be necessary for you to make an application to the court for the transfer into her joint name to be set aside and for a declaration that the property is vested in your sole name.
