Legal Question in Family Law in United Kingdom

Residency order

My childeren's father has served a residency order from england on me while I am staying with my family in scotland. The order has not been served with a statement attached. Is this order enforcable? I was required to submit a statement when I served my own temporary residency order on my childerens father otherwise it would not be legal.

Re: Residency order

Hi.I am not sure as to exactly what has been served upon you. Is it an application for a residency order which will be on a form C1.It is most unlikely that an actual residency order would be made without prior notice to you.

When applying for a residence order it is no longer necessary to include a full statement of facts in support of the application.

I would be happy to assist you further but before I am able to do so I will need much further information from you. In particular I will need to knowthe ages of your children and with whom they are living now. Please get in touch if you require further help.

Kind regards
