separating from partner but we have joint mortgage

i have been with my partner for 3 yrs and we have a 2 yr old son

we have a joint mortgage and i have decided that i dont love him any more and i want to leave him.

i have asked him if we can sell the flat and go our separate ways but he is refusing to sell the flat

can i make him sell it??

if we sell the flat i could get rent a flat with my son.

i do work part time 30hrs a week and i dont want to give up my job

please can you help me

Providing the property you share with your partner is jointly owned you are entitled to ask the court for an order for sale. The court will order that the property be sold and the net proceeds divided between you.

You should formally advise your partner in writing that you require the jointly owned property to be sold. If he still refuses to agree to a sale you will be able to obtain from our web site information on how to make the application to the court.
