unmarried couple separation joint mortgage

is the party left in the house entitled to half the mortgage payment when a couple is unmarried but has children. the mortgage initially was just in her name and she paid it, but two yrs ago they remortgaged in joint names. she has always paid the mortgage & him the household bills. she now wants half the mortgage plus child maintenance, what rights do either have and can she force him to pay?

The rights concerning this property will depend upon the beneficial interests in the house. In all probability the property is owned in equal shares between the parties and they will therefore be entitled to half the equity on sale.
