Legal Question in Family Law in United Kingdom
My wife is divorcing, what are my rights?
My wife has decided to divorce me after 14 years of, I thought, happy marrige. I suspect that there is someone else involved. there are 2 Children involved. I had owned my house for 10 years before I married my wife and she has contributed nothing financially towards it. As of last year we have a joint mortgage. She seems determined to clean me out by taking my children, my house and every penny she can get.
I would like to know what rights I have to keep my children, my house and as much of my money as I can? I am retiring shortly to assist in the court battle to keep the children but unfortunately this will give me a large (for me) lump sum which she also wants.
What steps can I take to protect my children and assets from her selfish greed?
Finally, what happens if I contest the divorce?

Re: My wife is divorcing, what are my rights?
I am sorry to hear of these problems which must of course be most distressing. You have a catalogue of rights when a marriage is dissolved although as a general rule the matrimonial assets must be distributed between the parties. your rights with regard to your children are not affected by divorce.
What if anything can be done at this stage will depend very much upon your personal circumstances of which I know nothing. It is technically possible to defend a divorce, but if a marriage is dead this is rarely beneficial. At this time I can probably do no better than refer you to the divorce pages on our web site, but if you wish please do not hesitate to come back to us for further help and advice.
