Legal Question in Civil Litigation in United Kingdom

Assignment of Judgements

I have recently been approached by an individual that is currently receiving payments from a large UK company for a tort claim the claimant won 3 years ago. He wanted to know if he could assign (ie, sell) his future payments under the claim to a third party investor who's willing to give him a lump sum payment now equal to the net present value of the future payments. He was not able to produce a copy of the judgement decree for me to review. Thus I wondered if, generally speaking, UK judgements tend to be assignable or not? Thank you for your help on this.

Re: Assignment of Judgements

based on my experience, I'd say you are asking the wrong questions here. Let me guess, this person is basically "selling" his rights to receive periodic payments from a tort settlement or judgment. There is no legal impediment, anyone can assign anything of value. That's not the issue. Does it not seem odd to you that although in order to do the assignment you have to have specific information as to the case and the payor on the judgment, you have not been shown any verifiable proof. How do you set the asking price unless you know how much and for how long. My advice: Trust but verify. Don't hand over any money until you have reliable assurances from a 3rd party. Good luck,
