Legal Question in Civil Litigation in United Kingdom

sue for breach of contract?

i have been dismissed by someone who did not have the authority to do so according to the terms of my contract. does this constitute a breach of contract? when they noticed this mistake had been made their was of correction was to offer myself another discoplinary hearing whilst no longer working for the company. i had received my p45 and final payslip. according to my union this would not be a major point at an employment tribunerial. would i have any case for sueing my former employer for breach of contract under this situation.

Re: sue for breach of contract?

It could well be that you have been wrongly or unfairly dismissed. Although the person who dismissed you did not have the authority to do so, I am presuming that he dismissed you on behalf of the company. This could well be evidence that proper procedures were not followed but I will need much more information of the facts surrounding the dismissal before I could give a definitive opinion. I shall also need to know the breach alleged of your employment contract.
