Legal Question in Immigration Law in

Hi there, I'm about to apply for permanent residency having been married to Hungarian citizen. I'm aware my wife has to excercise her treaty rights but unfortunately, due to being made redundant, having a baby, and not being able to find another job immediately, she has only worked for 4years 8months of the 5years required to exercise her treaty rights. My question is: should I be worried my application can be refused?

This could cause a minor complication, though, if so, the UK Border Agency will usually request further information from you. If she was made involuntarily redundant then usually she could be ok for a small period of time.

It is important whether or not your wife had completed her worker registration scheme (being a hungarian citizen, she would have had to do that for 12 months when she started work here).
