Legal Question in Immigration Law in United Kingdom
a friend of mine moved to the uk 8 months ago after marrying a british man, she's from cuba. Unfortunately the marriage has now broken down & she would like to get a divorce but the husband is threatening to get her deported unless she moves back in with him, which she is unwilling to do. Please could you advise as to how she stands legaally & what she needs to do to be able to remain in this country?

Unless the couple have children, there is not really anything your friend can do about the matter. She would have to leave the UK as she is no longer in a subsisting marriage with her husband (unless of course the couple decide to get back together).
If she does have children with her husband, then she may be able to make an application for access rights to the children, but this is generally very complicated.
If you would like to discuss this matter further, please feel free to contact our office at 01244 851274 or 07789294662 and ask for Mr Asif Salam.
