Legal Question in Immigration Law in United Kingdom

I was hoping someone might be able to help me.

I am an Australian living and working in the UK on a tier 5 youth mobility visa. I have been seeing an English guy for about a year. My visa runs out in July. Are there any ways I can stay in this country after July? I would preferably want to be working but was also wondering if I can stay in the UK after this date not working?

Any help would be much appreciated.

The Youth Mobility Visas are not renewable and you would not therefore be able to extend your stay in the UK on this basis.

The only other options for working in the UK are visas issued under the Points Based System, but these are difficult to obtain as the requirements either ask that you have an employee who is registered as a sponsor and is able to issue you with a certificate of sponorship, or require you to score points based on your qualifications and earnings in the UK.

The only realistic option based on the facts you have given seems to be for you to marry the British person that you are in a relationship with. In order for you to marry in this country, you would first need to apply for permission to marry from the Home Office.

Once this permission is granted, you would then be able to apply for leave to remain in the UK on the basis of that marriage. Please note that the permission to marry from the Home Office does not confer any leave to remain in the UK. You would therefore need to ensure that you have obtained the permission, married your partner and applied for leave to remain as his spouse, prior to your visa expiring in July.

I hope that this information assists you. Should you have any further queries you are welcome to contact us on 01244 344577 or alternatively via email at [email protected].
