Legal Question in Immigration Law in United Kingdom
Marriage or fiance visa?
I am a US citizen who married my algerian boyfriend of over a year(who is in the UK illegally) in an Islamic ceremony in the UK. The UK does not recognize the union, but I want to bring him here to the US. Can I apply for a spouse or fiance visa, despite the situation? Does the US recognize the union? Does his non status affect our chances? Should he return to Algeria and apply from there? Or, would it be possible legally and faster to return to the UK and marry him in a civil ceremony and then apply for a spouse visa?

Re: Marriage or fiance visa?
You can apply for a fiance visa. Probably, the US will not recognize the union as it is not recognized in the jursidiction where it was performed. I don't believe his lack of status in the UK would affect his application but I would have to double check. If you would care to consult I know some alternatives to what you suggest that might work even faster. The consultation fee is only $250. Contact me directly if you'd like to speak further.
