Legal Question in Intellectual Property in United Kingdom

Web Design Copied

I recently created a web site for a local Car Parts company, fully designed by myself.

However, last week I was notified that a rival company had completely copied the design of the main section of the site. The other company have stated that they did copy my design, saying they used it as a template, and while they change 2 of the three main images they used, they still kept an image to which I own the copyright.

I have been in contact with them, and while he admits he used my design as a template, he feels he should not have to change it because 'the colours are slightly different'.

I want to know if I would have a good case for compensation, i.e costs equivalent to my design time etc?

In England if the other developer has copied a substantial element of code or graphics then you would be entitled to damages for copyright infringment. The same may be true in Ireland but you would need to check with an Irish Lawyer.

You also need to check that you still own the copyright. didn't you assign it to your customer?
